The following are my (Lemurskii’s) Design Terms of Service.  Before purchasing or offering on an adopt or custom, these should be read.  Upon purchase, you are signifying that you have read these terms of service and that you are in compliance with all that is listed.  (Note that mystery reveal adopts are considered customs)

What You Get

• I have the right to decline any buyer/offer, without giving my reasons.

• I will only draw animal characters.  Feral or Anthro.  If you are looking for human-based designs, look elsewhere.

• I am comfortable with drawing most if not all types of animals, including made up or original species and hybrids.  If you’re uncertain on a species feel free to ask me.

• I will not design fan characters from certain pop media, video games, movies, etc. Especially those that require specific styles to draw in (ex. Sonic, MLP, Steven Universe, etc)

• I will not design customs that display exposed genitalia (This does not include male nipples)

• I can draw:

  • Animals (Mammals, Reptiles, Fish, Bugs, Anything)

  • Weird hybrids, Creatures, or Original Species

  • Feral Animals or Anthros/ Furries

  • Some accessories and clothing (requires addons)

  • Designs involving Gore (Mild or Extreme, it doesn’t matter)

  • Designs involving possible Trigger Themes, depending on the theme.  (I will not draw things related to suicide or extreme self harm.  I can however draw things relating to certain mild drugs (pills, marajuana, smoking), phobias (trypophobia, thanatophobia, etc), and mental illnesses.)

  • Feel free to ask if there is something you are uncertain on

• The only things I'm not comfortable with drawing are: 

  • Humans

  • In styles other than my own (Cartoon styles, other artist styles) 

  • NSFW artwork (This includes nudity, vore, fetishes, and intense sexual themes).

  • Exposed Nudity in customs

  • Complex robots (Animatronics are fine, robots with complex parts are not.  Please ask me whether or not it's too complex!)

  • Overly complex clothes or accessories.

  • Characters relating to political topic.  

  • I will not draw anything related to hate on certain races, orientations, genders (homophobes, sexism, etc).

  • I will not draw sexual or suggestive content, or any content regarding things such as pedophilia or non consentual sexual content (And I will probably block you if you ask for it.)

• You can ask for a speedpaint!  I'm more than glad to make them.  Sometimes I might not be able to.  I try to make speedpaints of most of my work [Busts, Fullbodies, and Customs only]

• Finished Customs are flat coloured with a solid colour background.  It can be requested (when ordering, not after the custom is finished) for a single fullbody version without background or addons, or for individual addons.

• I styalize OCs.  If you think that there might be a problem regarding my style altering your character, feel free to try and discuss this, but note I might still decline to change things about my style.

Custom Requirements

• Be sure to make the description for your custom as detailed as you want it.  Include everything you want in your custom.  I will ask questions and check my work if needed, but if there are mistakes made due to your part I might not be able to fix them.

• Based on the details you give, what you get is what you get.  No refunds or edits if you’re not happy with the outcome.

• Customs can be ordered in a number of ways, either by leaving a comment on the panel post, sending me a note through DA or DMing me on insta, or via email (note or DM me for an email).

• In order to order a Custom:

  • Complete the template provided here or in the panel description:

    • Commission type: Custom

    • Any wanted addons (check reference addons):

    • Character Description (be sure to include species, gender, and any specific themes or colour palettes you'd like.  Or if you like you can keep details as minimal as you’d like):

• You may request for me to send you a higher quality version via email or other means.

• Do communicate with me, and give me details in your note! I don't mind receiving lots of details and description for a character; better too many than too little! I also love reading about a character's background and personality, it helps me in getting ideas ;D

• I will always send wips for customs during the sketch and colouring process.  This way you can make sure the design looks alright before finishing the custom.

• Feel free to ask for WIPs or ask me about progress along the way!  As long as you are not trying to rush me, I’m happy with showing sketches or letting you know how far along I am.

• When a commission is finished, it will most likely be uploaded to my Deviant, Instagram, and possibly Youtube, and you can request an HD/Unwatermarked version to be sent via email or other means. However, I will not remove the signature and I ask you kindly not to remove it either. No worries, it won't be in the way of the image or anything!

Payment

• I accept Points and Paypal (USD)

• Please only offer the correct payment on the following:

  • For Flatsales: Points or Paypal (USD)

  • For Auctions: Points or Paypal (USD) (Bids must be a part of the auction comment chain to be considered valid)

  • For OTAs (Offer to Adopt): Art, OCs, Points, or Paypal (USD)

  • For OATA (Offer Art to Adopt): Art, Points, or Paypal (USD)

  • For OOCTA (Offer OCs to Adopt): OCs, Points, or Paypal (USD)

• I will only start a custom after payment has been received.

• I will not allow any payment plans for customs such as paying after or half up front, rest after I finish.

• I can decline putting an adopt an hold without giving my reasons

• I will only put an adopt on hold for two weeks.

• The prices shown in my commission panel for customs are subject to change.  (This note will be taken down when the panel is updated: At the moment, my prices are fluctuating.  They may turn out to be a little, if not much higher than the prices presented on the panel).  If I feel as though your character is over complicated for the highest price given on the commission panel, I can bring the price up to my liking.

• When the payment is with points, please do not send them until I tell you where to send them to! I will make a commission widget available on my page specified for you.  DO NOT send the points to my donation pool or as a 'gift'!

• I do not offer refunds unless I find the commission to my inconvenience.

• If you take more than 48 hours to respond after requesting a custom, I will most likely give your slot to somebody else.  This includes after confirming the price.  You have 48 hours to send the points/money or I will most likely give your slot to someone else.

• If you are approved to buy an adopt, you have 48 hours to send the points/money/OCs.

• If you are approved for an adopt via art offers, there will be a deadline created based on how much is offered for the offers to be submitted.  Please inform me if something happens during that time (ex. Loss of art materials) and we will discuss a solution.

• Unwatermarked versions of adopts will only be sent to the buyer after payment is completed

• Do NOT request/purchase/or offer on an adopt or custom if you do not have the money/points/or means then to pay for it.  This also includes things such as not having the available materials to complete art offers or offering OCs that are not yet yours.

Time

• I do not accept deadlines on any custom, no matter the price.  Purchasing a custom from me risks a long wait.  You could receive your custom in under a day, or dare I say a month or more.  I do try to stay on top of my schedule though.  My customs are always top priority, but I'm allowed to take breaks for other things in between.

• I have a To-Do list on my account.  I complete customs, and commissions in order of which they come and when I have the ready material.

• I complete customs in usually under 3-5 hours.  If it takes me a while, assume I have not yet started.

• If you try to cancel a custom or adopt (mystery reveal), you can do so, but you will not receive a refund.

• Autobuys and Flatsales are first come first serve

• Auctions always end 48 hours after the final bid, unless stated otherwise

Rights

• I, the artist, hold every right to the produced drawing of the custom or adopt, not the commissioner/ buyer (unless linework produced by other artists is used).

• I'm allowed to use the finished artwork in my portfolio and to upload it to my own page.

• If you are uploading my design to toyhouse, you HAVE to credit me as the creator, and credit any art produced by me as well.  My toyhouse username is Lemurskii.

• Commissioners are not entitled to the PSD, MSD or other files which contain layers. I will only send the commission as a png file.

• If you post the custom/ adopt somewhere, please credit me by either linking back to my page, tagging me, or making sure my username and medias are included (ex. Lemurskii - Deviantart, Lemurskii - Instagram)

• Credit also needs to be applied to any projects the art may be used (Youtube videos, PMV Tributes, etc.).  Please ask for permission before doing this!

• Please ask before editing my artwork for a custom or adopt.  While design changes are fine, there are some things that I am not okay with when it comes to editing my artwork.

• The commissioner is never permitted to edit/modify, distribute, make merchandise, claim credit, use for advertising whether under any circumstances without my permission

• I will not accept “private customs”.  I will freely post whatever you ask of me to draw.  However, if you’d to discuss a schedule to post (ex. If it’s a gift for a friend, or you’d like to do an OC reveal first) let me know.

• Adopt or Custom buyers can request a transfer of the design and any images of it via toyhouse.

• Adopt or Custom buyers are allowed to make design changes to their purchased design, including gender changes, palette changes, changes in species, etc.

• Please do not change your design to the point where it doesn’t resemble the original design.  No matter what the changes are, I will still expect credit for the design.

• Adopt or Custom buyers are NOT allowed to resell their design for any higher than they purchased it (unless they have collected more artwork of that design.)  In the case of more artwork being acquired, please only increase the design value based on how much you paid for the additional artwork.  If the artwork is yours, however, feel free to decide your own work’s worth.

• Adopt or Custom buyers are allowed to trade or regift their designs.

• Feel free to use the image from customs or adopts as a reference image.  However please ask me for permission before directly editing my artwork for design changes, as I might not be okay with certain edits.

• Please inform me if you do end up selling/gifting/or trading your design away

• There are no refunds on both adopts and customs

• Claiming my designs or art as your own is stealing!  Do NOT claim my designs or art as your own!

• And it should already be implied that stealing, tracing, or non permitted referencing of my artwork in any way is a major DON'T.
